Ukrainian Legislation Formation on the Principles of Christian Doctrine

Abstract
The article tells about the influence of Christianity on our legislative process beginning with the Kievan Rus christening and ending with the adoption of the already independent Ukrainian Constitution. It is proved that Christian ideology has not only spiritual and cultural character but legal one too. History has shown that taking the orthodox religion in Kievan Rus had introduced new norms and standards of life. The process of active implementation of the new Christian morality began. Separately the impact of sights canon law on the old Rus law is observed in the texts of Ruska Pravda. Eloquent work of Metropolitanate Hilarion «Word about Law and Grace» played an outstanding role in the Kievan Rus. In his work a talented writer and speaker revealed originality-rusyn understanding of Christianity: all people are equal before God; priority to evangelical principles of the organization of social infrastructure; responsibility of the individual for his actions before God and the whole nation – for the cause of creating a new Christian civilization and etc. Then it was analyzed the Philip Orlyk Constitution in which from the preamble flow out explicit choice of it authors Christian vision of world history in general and the history of ukrainiancossack people. Further the author focuses on the Constitution of the USSR, and emphasizes the rules of this law, in which christian principles are reflected. For example the аrt. 32 of the Constitution of the USSR «Citizens of the USSR are equal before the law regardless of origin, social and property status, race and nationality, sex, education, language, attitude to religion, occupation, place of residence and other circumstances». To summarise the author dwells on Constitution of Ukraine (1996) which was the most striking example of the combination of legal and christian religious components. Especially significant proportion of christian doctrine laid down in Section II «Rights, freedoms and duties of man and citizen», because in it special attention is paid to such moral and ethical values as freedom, equality and justice, without which, in our opinion, any democratic state can not be built.Downloads
