Bicameralism as a Product of Historical Evolution

Abstract

This article provides a concise analysis of philosophical and scientific aspects of the institute of a bicameral parliament. Taking into account the need of reformation of the national public authorities, especially legislative branch, there is also a need of rethinking of cultural, spiritual and historical values prevailing in the development of Ukraine. A scientific comparative analysis of bicameralism in Europe and the United States of America was made through correlation between theory and history of State and Law with Philosophy. Presenting the ongoing debate about the implementation of bicameralism in the state system, we didn’t find a direct connection between the above mentioned phenomena. It is proved that some countries inherited bicameral parliaments historically while others have created them in the process of evolution. Regardless of the causes of bicameral parliament’s creation we could say that they did not lead to the changes of the political systems of the countries. It is also important to note that bicameralism acts as an indicator of society and state’s development. The structures and compositions of bicameral parliaments of several countries are presented. This helped to understand the feasibility of implementing the parliamentary system which is possible only in case of high social and legal maturity of Ukrainian citizens. Almost all scientific researchers are trying to find an answer on the eternal question of the Philosophy of Law: «Which one among the political systems and public authorities is the best?». We made a deep analysis of government institutions in order to research the process of bicameralism’s formation. Taking into account that Ukraine is a parliamentary – presidential country and the key authority is the government, the possibility of offering the best model of parliament, taking into account the stage of development of public legal awareness of Ukrainian citizens, is quite important today. The philosophical reconsideration of the mentioned problem is a driving force for evolution process which, in its own turn, leads to progressive and systematic reforms. In the country and its society decisions should always be made on the ground of accounting of possible future consequences. To manage the strategic forecast, statesmen should be intelligent and well-educated. As the history shows, the best and the most successful leaders of all times were philosophers. Therefore, the study of bicameralism as a product of legal awareness of citizens’ evolution is in need of philosophical thinking and analytical study of the cultural, historical and civilization development of separate countries and their peoples.
