Somatic Rights as a Cluster of Legal Guarantees «Self-Ownership» in the context of Transhumanism
Abstract
The purpose of the article is to analyze the research on the issues of somatic rights; identify the reasons for their appearance and registration in the legal guarantees of disposal of one's own body; show that somatic rights are the result of major worldview changes that took place in the twentieth century. The methodological basis of the article is a set of philosophical and general scientific methods. Determinants are the method of dialectics, comparative and hermeneutic, as well as sociocultural and axiological approaches. Scientific novelty. Modernity shows us the transformation the classical concept of human rights by significantly expanding the types of these rights, which are also called «new», which include the human right to their own body, the right to adequate nutrition, information and digital rights, etc. Somatic rights are linked to a new kind of humanism –transhumanism, which appeals to the latest advances in science and technology and legalizes the use of these achievements to improve, modify, reconstruction of the human body. Conclusions. Somatic human rights as one of the types of «new» human rights are associated with the tendency to «anthropologize the law». Legal consolidation of somatic rights as «self-ownership» by the body enabled the processes of improvement, modification and reconstruction of the human body, which led to the appearance of Lego Man. Besides, they are closely related totolerance.
